Terms of Service

Agreement
These Terms govern your access to and use of RetainProof™ ("the Service"), a product of CMD Marketing Enterprises LLC provided through CMD+DesignLab. All contracts, subscriptions, and payments are administered by CMD Marketing Enterprises LLC. By creating an account or using the Service, you agree to these Terms on behalf of your firm.
The Service
RetainProof provides tools to track marketing spend, reconcile vendor invoices, attribute leads to signed cases, and generate reports. Features vary by subscription plan. We may improve or modify features over time.
Accounts & security
You are responsible for your account credentials and for all activity under your account. You must provide accurate information, keep credentials confidential, and enable available security controls such as two-factor authentication where appropriate.
Subscriptions & billing
Paid plans are billed monthly in advance, or annually with a prepayment discount. Implementation fees are quoted per firm and invoiced separately. You can cancel at any time; access continues through the paid period. Fees are non-refundable except where required by law.
Your data
You retain ownership of the data you submit. You grant us a limited license to process it solely to provide the Service. Our handling of your data is described in the Privacy Policy.
Acceptable use
You agree not to misuse the Service, attempt unauthorized access, upload unlawful content, or use it to violate applicable advertising, bar, or privacy rules that apply to your firm.
Professional responsibility
RetainProof is a business tool, not legal or accounting advice. You remain responsible for your firm's compliance with applicable rules of professional conduct and advertising regulations.
Disclaimers & liability
The Service is provided "as is." To the maximum extent permitted by law, we disclaim implied warranties and our aggregate liability is limited to the fees you paid in the 12 months preceding a claim.
Termination
You may stop using the Service and delete your firm's data at any time. We may suspend or terminate access for breach of these Terms or non-payment.
